Justice Bhuyan of the Supreme Court criticized the CBI, writing a separate concurring opinion granting Arvind Kejriwal’s Bail to Delhi Chief Minister Arvind Kejriwal in the CBI case filed over the alleged liquor policy scam. He said that the CBI should not be seen as an overbearing investigative agency, but rather as the nation’s premier investigative body. Instead, it should strive to dispel any notion of bias and be viewed as an uncaged parrot.
“The CBI is the nation’s top investigative body. It is in the public interest that the CBI be seen to be above board as well as above board. It is imperative to make every attempt to dispel any impression that the investigation was conducted impartially and that the arrest was made in an arrogant and prejudiced way.
Perception is important in a legal democracy that functions well. An investigating agency needs to be above board, just like Caesar’s wife was. This court recently chastised the CBI, likening it to a parrot in a cage. CBI needs to refute the idea that it is a parrot in a cage. Instead, imagine a parrot that is not in a cage.”
The observation came as a bench of Justices Surya Kant and Ujjal Bhuyan issued a decision today on Kejriwal’s appeal of an August 5 Delhi High Court order that denied his requests for Arvind Kejriwal’s bail and to contest the CBI’s arrest, leaving him free to file a bail request with the trial court. On September 5, the bench had reserved its decisions following a thorough hearing of the case. It rendered two distinct, in-agreement rulings today.
Judge Bhuyan questioned the need and timing of Kejriwal’s arrest and stated that his continued detention is completely unjustifiable, particularly because he has already been granted bail in the money laundering case resulting from the liquor policy “scam.” Justice Surya Kant found no illegality in the CBI arrest. The judge pointed out that Kejriwal was apprehended by the CBI on the verge of his release in the ED case, having been out of custody for more than 22 months.
What did the SC Bench say about Arvind Kejriwal’s Bail?
Even though Arvind Kejriwal’s Bail was unanimously granted by both judges, Justice Ujjal Bhuyan disagreed with Justice Kant regarding the CBI arrest, stating that it was solely done to “frustrate bail” that had been granted in the Enforcement Directorate (ED) case.
In his ruling, Judge Surya Kant stated that Kejriwal would be freed provided he provided a bail bond of Rs. 10 lakh and two sureties in the same amount. In addition, he mandated that CM refrain from publicly discussing the merits of the CBI case. Kejriwal had filed two petitions in the case, one contesting the CBI’s decision to uphold his arrest and the other contesting the denial of bail.
The Case so far
The Enforcement Directorate detained Kejriwal on March 21 in connection with a money laundering case involving the now-canceled excise policy. He was formally taken into custody by the CBI on June 26 about the purported scam.
In the money laundering case, the Supreme Court granted him temporary bail on July 12. He’s being detained in judicial custody at the moment about the CBI’s corruption investigation. Just two of the 40 accused in the related cases—businessman Amandeep Singh Dhall and activist Kejriwal—remain incarcerated.
